How the Process Works
1. Select an Eligible Property
Contact Southwest America Land Company to confirm whether financing is available for the property you wish to purchase. Financing is not available for every property and is subject to Seller approval.
2. Review the Financing Terms
You will receive a written Land Contract identifying:
- The property and parcel number
- Total purchase price
- Monthly payment amount
- Payment due dates
- Length of the payment plan
- Default and cure provisions
- Deed-delivery process
- Other applicable terms
3. Sign the Land Contract
The Land Contract can be reviewed and signed electronically. The agreement becomes binding after it is properly signed and any required initial payment is received.
4. Make Monthly Payments
Payments are made according to the schedule included with the Land Contract. Payment reminders or secure electronic invoices may be provided before each due date.
You may pay additional amounts or satisfy the remaining balance early without a prepayment penalty.
5. Receive Your Warranty Deed
Southwest America Land Company retains legal title until the purchase price and all other obligations under the Land Contract are satisfied.
After the property is paid in full, Southwest America Land Company will prepare and submit a Warranty Deed for recording with the appropriate county. A copy of the recorded deed or recording confirmation will be provided when available. County processing times may vary.
Property Use During the Payment Period
Unless the Land Contract specifically provides otherwise, the Buyer may not occupy, camp on, improve, grade, fence, excavate, lease, transfer, store property on, or install structures, utilities, wells, septic systems, manufactured homes, mobile homes, or recreational vehicles on the property before the Warranty Deed is recorded.
Any use of the property must also comply with applicable laws, zoning, permitting requirements, recorded restrictions, and county regulations.
Buyer Due Diligence
All properties are sold in their current AS-IS, WHERE-IS condition unless otherwise stated in writing.
Before purchasing, Buyers are responsible for independently verifying all matters important to their intended use, including:
- Recorded legal description
- Parcel boundaries and acreage
- Legal and physical access
- Road conditions and maintenance
- Zoning and permitted uses
- Minimum parcel-size and building requirements
- Manufactured-home and recreational-vehicle rules
- Utility availability and connection costs
- Water availability and well requirements
- Septic feasibility and permitting
- Recorded easements, covenants, and restrictions
- Property taxes and assessments
- Flood and environmental conditions
- Suitability for the Buyer’s intended use
Maps, photographs, measurements, boundary depictions, utility distances, and other property information are provided for general reference and should not replace independent verification, recorded documents, or a survey performed by a licensed surveyor.
Final Sales and Refunds
Except as required by applicable law or agreed in a written document signed by Southwest America Land Company, completed property purchases are final and non-refundable.
A Buyer may not cancel a transaction or demand a refund merely because the Buyer changes plans, later determines that the property is unsuitable for an intended use, or fails to complete due diligence before signing.
Missed Payments
The applicable Land Contract will explain when a payment becomes delinquent and describe the notice and opportunity-to-cure process.
If a default is not cured within the time provided by the Land Contract, Southwest America Land Company may terminate the agreement or pursue other remedies available under applicable law. A Warranty Deed will not be delivered or recorded while a default remains unresolved.
