These Terms and Conditions govern your access to and use of https://southwestamericaland.com/ (the “Website”), including browsing property listings, submitting inquiries, making online payments, and purchasing vacant land offered by our Company.
By accessing or using this Website, you agree to these Terms and Conditions to the extent applicable to your activities. Individual property purchases are also subject to the applicable purchase agreement, financing agreement, and other transaction documents.

2. Property Listings and Availability
We make reasonable efforts to ensure that property listings are accurate and current. Listings may include property locations, parcel identification numbers, legal descriptions, approximate acreage, photographs, maps, prices, and other property information.
Property information may be obtained from public records, county assessor databases, mapping services, third parties, and other sources. Errors, omissions, and outdated information may occasionally occur.
Maps, photographs, GPS coordinates, and parcel outlines are provided for informational purposes and do not replace a professional survey or recorded legal description.
Property availability and prices may change without notice before a purchase agreement is finalized. A property is not guaranteed to be available solely because it appears on the Website.
Buyers are responsible for reviewing the applicable purchase documents and verifying information material to their intended purchase.
3. Online Land Purchases
Our Website may allow customers to inquire about, select, or purchase available properties online.
Depending on the transaction, the purchasing process may include selecting a property, reviewing the purchase price, providing necessary information, signing transaction documents, submitting payment, and completing the requirements for deed preparation and recording.
An inquiry, property selection, automated confirmation, or payment receipt does not by itself establish that legal title has transferred.
The applicable purchase agreement, financing agreement, deed, and governing law determine the parties’ rights and obligations.
A separate purchase agreement may be required for each property transaction.
4. Purchase Prices and Fees
The purchase price will be displayed in the applicable listing or transaction documents.
Any additional charges payable by the buyer, including applicable recording fees, taxes, or optional third-party services, should be disclosed in the applicable transaction documents before the buyer becomes obligated to pay them.
Buyers are responsible for reviewing the total purchase price and any applicable charges before completing a transaction.
Property ownership may involve additional expenses, including property taxes, assessments, surveys, maintenance, utilities, permits, and other costs not included in the purchase price unless expressly stated otherwise.
5. Payment Processing Through Stripe
We may use Stripe to process online payments. Stripe is a third-party payment service provider and is not the seller of the property.
Payments processed through Stripe are subject to the applicable Stripe terms, policies, and requirements.
Official Stripe resources:
Stripe’s terms govern the applicable payment-processing relationship and do not replace the purchase agreement between the buyer and Southwest America Land Company LLC.
Payment confirmation, authorization, or receipt does not by itself establish that a property sale is complete or that ownership has transferred.
Customers should use authorized payment instructions and retain payment confirmations. Questions about a property purchase, payment, cancellation, or refund should be directed to our Company.
Refunds and payment disputes are handled according to the applicable purchase agreement, payment terms, and applicable law.
6. Owner Financing — 0% Interest, Maximum Six Months
Southwest America Land Company LLC may offer owner financing for eligible properties at its discretion. Owner financing is not guaranteed to be available for every property or buyer.
When owner financing is offered and approved, the following general conditions apply:
- Interest rate: 0% interest on the financed purchase price.
- Maximum repayment period: Six (6) months.
- First payment: Due immediately after the buyer accepts the applicable financing agreement and completes the required purchase documentation, subject to the payment instructions provided for the transaction.
- Payment schedule: Established in the individual written financing agreement.
- Final payment: The entire outstanding purchase balance must be paid within the agreed repayment period, which cannot exceed six months under this policy.
- Deed transfer: The deed will be transferred only after the final payment has been received and all other applicable contractual requirements have been satisfied.
The individual financing agreement will identify the purchase price, any down payment, financed balance, installment amounts, due dates, final payment deadline, and any expressly agreed fees or charges permitted by law.
No interest will accrue on the financed purchase price under an owner-financing arrangement governed by this policy.
Owner financing must be approved by our Company and documented in writing. A buyer must not assume that selecting a property or making an initial payment automatically qualifies the buyer for financing.
Late Payments and Default
Failure to make a payment when due may constitute a default under the applicable financing agreement.
Any permitted late fees, required notices, cure periods, and available remedies will be governed by the written agreement and applicable law. No cancellation, forfeiture, foreclosure, or other remedy involving real property will be exercised except as permitted by the agreement and law.
Deed and Ownership Transfer
For owner-financed purchases, the deed will be prepared and submitted for recording after the buyer has paid the entire purchase price and satisfied the other applicable contractual closing requirements.
The precise timing and legal effect of the transfer will be governed by the transaction documents and applicable law.
7. Cancellations and Refunds
Refunds and Cancellations
All sales are final. No refunds will be issued. Once a purchase is completed, buyers are not entitled to a refund for any reason, including a change of mind, change in intended use, dissatisfaction with the property, or failure to conduct adequate due diligence before purchasing.
Buyers are responsible for reviewing all property information, conducting their own due diligence, and confirming that the property meets their needs before completing a purchase.
For owner-financed purchases, all payments and obligations are subject to the applicable financing agreement. Cancellation, termination, or default does not automatically entitle a buyer to a refund of payments previously made.
To the fullest extent permitted by applicable law, Southwest America Land Company LLC reserves the right to enforce its no-refund policy for all property sales and transactions.
Nothing in this section excludes any refund or remedy that is required by applicable law.
8. Property Condition and Buyer Due Diligence
Unless otherwise expressly provided in the applicable purchase agreement, properties are offered in their existing condition, subject to representations, disclosures, and obligations that cannot legally be excluded.
Before purchasing land, buyers should independently investigate matters relevant to their intended use, including:
- Property boundaries, acreage, and legal description.
- Legal and physical road access.
- Zoning, permitted uses, and building restrictions.
- Availability of electricity, water, sewer, septic systems, and other utilities.
- Water rights, well permits, and groundwater restrictions.
- Property taxes and assessments.
- Easements, covenants, restrictions, and other title matters.
- Flooding, drainage, soil conditions, environmental concerns, and topography.
- Permits and other requirements for development or construction.
Buyers may consult county offices, planning and zoning departments, surveyors, engineers, title professionals, and qualified legal professionals.
We do not guarantee that a property is suitable for a particular use unless an express written representation is made in the applicable purchase agreement.
9. Property Use and Development
Purchasing vacant land does not automatically authorize a buyer to build a residence, place a manufactured home or recreational vehicle, camp, install utilities, construct a septic system, drill a well, subdivide the property, or undertake other activities.
Such activities may require permits, approvals, inspections, or compliance with local restrictions.
Buyers are responsible for determining whether their intended use complies with applicable federal, state, county, municipal, subdivision, and other governing requirements.
10. Deed Preparation and Recording
The applicable purchase agreement will specify the deed to be prepared and the requirements for completing the transfer.
For cash purchases, deed preparation and recording will occur after receipt of the full purchase price and satisfaction of the applicable contractual requirements.
For owner-financed purchases, deed preparation and recording will occur after receipt of the final payment and satisfaction of the other applicable contractual requirements.
The form of deed, interest conveyed, and any title warranties will be governed by the executed transaction documents.
County recording offices control their own processing schedules. We cannot guarantee a particular recording date or guarantee that a county will accept a deed for recording.
11. Property Taxes and Ownership Costs
Property taxes, assessments, and other charges will be allocated according to the applicable purchase agreement and law.
Buyers should verify property tax information with the appropriate county tax authority and ensure that taxes attributable to their ownership are paid when due.
Unless otherwise agreed in writing, buyers should expect to be responsible for applicable property ownership expenses from the relevant transfer date, subject to the transaction documents and law.
12. No Guarantee of Investment Returns
Information on our Website is provided to help prospective buyers evaluate available properties.
Unless expressly stated in a signed agreement, we do not guarantee future property appreciation, resale value, rental income, investment returns, development approvals, zoning changes, infrastructure projects, or future utility availability.
Buyers should independently evaluate the financial risks associated with purchasing vacant land.

To the extent permitted by applicable law, you are responsible for losses or claims arising directly from your unlawful use of the Website, fraudulent submissions, or material breach of these Terms.
Nothing in this section requires you to indemnify us for our own negligence, wrongful conduct, breach of contract, or other liabilities to the extent such an obligation is prohibited by law.
18. Governing Law and Disputes
These Terms concerning use of the Website are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Nothing in this section prevents a party from bringing a claim in a court that has jurisdiction where applicable law requires or permits the claim to be brought.
19. Changes to These Terms
We may update these Terms and Conditions to reflect changes in our business practices, Website features, payment services, financing arrangements, or legal requirements.
Updated Terms will be posted on our Website with a revised “Last Updated” date.
Changes to these general Website Terms do not automatically modify an already executed purchase agreement or financing agreement.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
21. Entire Agreement
These Terms govern general use of our Website and should be read together with our Privacy Policy and any applicable purchase agreement, financing agreement, deed, disclosures, and other transaction documents.
The executed transaction documents govern the specific property sale and financing arrangements to the extent of any inconsistency with these general Website Terms.
